Terms and Conditions for Duty Collection and Clearance Services

Please read these Terms carefully before completing payment. By making a payment through our platform, you confirm that you have read and accepted these Terms.

1. Role and Scope of Services

Mark 3 International provides customs clearance and logistics-related services for shipments entering the United States. We may act as a principal logistics provider or as a coordinator of customs clearance and handling services delivered through third parties. Our services include arranging customs clearance, coordinating duties and taxes, engaging customs brokers, and arranging onward handling and delivery.

2. Charges, Duties and Payments

Charges may include duties, taxes, government fees and third-party logistics costs. These charges are required to complete customs clearance. Duties are determined solely by U.S. Customs and Border Protection (CBP). Duties are paid to CBP through a licensed customs broker within our service chain.

3. Nature of the Service

Payment is made for the clearance and logistics services required to release and deliver your shipment. It is not a standalone financial service.

4. Non-Refundable Charges

Once clearance has been completed and charges have been incurred, payments are non-refundable. Any remedy lies with the seller or carrier.

5. Duty Recovery

In limited cases, duty recovery may be possible via CBP processes. Mark 3 may assist but cannot guarantee outcomes.

6. Regulatory Changes

Duty rates are set by U.S. law and may change. Mark 3 will cooperate with any official refund process if applicable.

7. Customer Responsibilities

Customers must ensure accurate shipment information. Any penalties or adjustments imposed by CBP remain the customer’s responsibility.

8. Limitation of Liability

Mark 3’s liability is limited to the service fee charged. We are not liable for delivery issues, delays, or product-related matters.

9. Third Parties

Mark 3 may engage brokers, carriers and agents and is not responsible for their actions.

10. Non-Payment

Failure to pay required charges may result in delay, return or disposal of the shipment.

12. Governing Law

13. Acknowledgement

By making payment, you confirm acceptance of these Terms.
